Recent Case in the American Association for Justice’s Professional Negligence Reporter
According to a recent case report in the American Association for Justice’s Professional Negligence Reporter, a federal court in Canton, Ohio recently awarded the family of an 80 year old nursing home resident $1.93 million dollars. Apparently the patient was given medication that wasn’t ordered for her which then caused hypoglycemia-very low blood sugar- resulting in permanent brain damage that eventually led to her death. The nursing home’s medication cart was disorganized and the facility was understaffed. The 80 year old patient was survived by four adult children. The verdict included $1.25 million in punitive damages.
In Illinois, punitive damages are banned in medical negligence cases. The legislature also repealed a law that used to provide for treble damages in nursing home abuse cases.
