Placzek Winget & Placzek is devoted exclusively to issues revolving around civil litigation (trials). In most instances, the litigation involves our firm representing injured parties or relatives of individuals who have died. Since our firm is almost exclusively devoted to representing the injured, our practice is for all intents and purposes closed to insurance companies or corporations asking for assistance in defending an injury claim or wrongful death claim. The attorneys are seasoned (with the senior litigator spending his entire career of 37 years litigating personal injury cases). Likewise, the firm is purposely kept small (it has three attorneys, and two paralegals) so that it might provide personal and timely service to its clients. We strive to return phone calls, answer all questions, and keep the clients fully informed as to the status of their case by sending the clients copies of materials received and generated in the ordinary course of our representation. Our goal is that when the case is concluded and the client leaves our office for the last time, that he or she is totally satisfied with the way the attorneys and staff have treated the client.

Unfortunately, not all injured individuals have lawsuits or claims that entitle the person to recover. In this respect, we often investigate a case before agreeing to enter into a Contract of Employment with the client. The investigation (and the time and expenses incurred) are done at no charge, and the client is not obligated to pay said expenses or investigation fees until such time as a written Contract of Employment is entered into. Likewise, until such a contract is entered into, the client is always free to seek legal representation elsewhere. We strive to ensure that our clients are comfortable with us and the methodology we utilize in pursuing their claim.

Typically, the Contract of Employment between our firm and our clients is a written contract, and is on a contingent fee basis (clients pay us only a percentage of the recovery). The written contract also states that if no fee is recovered, no sums are due and owing the attorneys. The attorneys also advance all sums necessary to prosecute the case so that the client is not required to advance any money for expenses. If the attorneys are successful in pursuing the case, then the sums advanced are paid back to the attorneys. Likewise, if the attorneys are not successful in obtaining a recovery, then a provision in the Contract of Employment specifically forgives all sums advanced.
